AIMPOINT MEDIA PORTAL

Usage Requirements

Access to the Aimpoint Media Portal requires:

  • A user account with valid username
    and password
  • Acceptance of the below Terms and
    Conditions of Use
  • Acceptance of the Aimpoint Privacy Policy

TERMS AND CONDITIONS OF USE

Acceptance of the Terms and Conditions of Use means that the user has read all the Terms and Conditions below. The Terms and Conditions of Use are binding on all users.

Terms and Conditions of Use include all media file types available for download, even if only file or media file is referred to/mentioned in the following text.

The user must always note that a media file may have special/limited usage rights and act accordingly to them when using the file.

These files are marked with an exclamation mark in the list view and have file specific usage rights description presented in the lightbox view. In such cases, the alternative and/or additional usage rights shall be given priority over the general usage rights stated in the Terms and Conditions of Use below.

User means the person, organization or company that downloads and uses an image or any other media file type (film, publication, logotypes etc..) from the Aimpoint Media Portal.

Aimpoint reserves the rights to change these Terms and Conditions of Use from time to time at its sole discretion.

TERMS AND CONDITIONS IN BRIEF

These Terms and Conditions of Use are binding on all users:

  • Media files may be used free of charge in advertising, publications, and editorial coverage with the purpose of promoting Aimpoint products, brand, or company. 
  • Files may only be used by the user who downloaded them and accepted the terms and conditions of use. Downloaded files are not to be transferred to third parties. 
  • If a downloaded media file will be used again, it must be downloaded again, since new Terms and Conditions may be applicable to the file.
  • Media files may NOT be used in any context that is not included among the environments in which Aimpoint products are used. Any other use requires permission of Aimpoint.
  • If Attribution/Credit line is required in conjunction with the use of a media file, the name of the photographer or producer shall be indicated in/on the media file, and when not possible, it shall be placed as close to the media files as possible.
  • Media files with special/limited usage rights, may only be used according to the specified terms and condition stated under “Usage Rights Descriptions” in connection to the file at the time of download.
  • The user: person, company, or organization, who downloads files from Aimpoint Media Portal is responsible for compliance with the Terms and Conditions of Use.

USE OF MEDIA FILES

The below applies to both printed and digital use.

Media files from the Aimpoint Media Portal may, unless other terms and conditions have been specified for a media file, be used free of charge for the purpose of promoting Aimpoint products, brand or company in advertising, publications, and editorial coverage.

Media files are only allowed to be used/presented in the natural usage environments of Aimpoint products, meaning product field of use such as sport shooting, hunting, law enforcement and military. Any other use requires permission from Aimpoint.

Usage in informative publications with the purpose of increasing the knowledge about red dot sights in general is permitted. For example, it is permissible to use files in product test articles or videos to inform users about the benefits of red dot sights.

Merely using a file without clear reference to red dot sights or its natural usage environments is not deemed to promote the use of Aimpoint red dot sights or red dot sights in general and is, therefore, prohibited.

Image files may NOT be manipulated or distorted. Changes to, misrepresentation of, or misuse of any files is strictly prohibited except for proportional resizing.

Video files must be used in their original uncut form.

Aimpoint trademarks, logos and taglines/slogans shall NOT be distorted, obscured, manipulated, or used in sizes that make it unrecognizable. Aimpoint Graphic and Trademark Guidelines must be read and followed. Download access to trademarks, logos and taglines/slogans require a confirmed Aimpoint customer relation.

USER

User means the person, organization or company that downloads and uses an image or any other media file type (film, publication, logotypes etc..) from the Aimpoint Media Portal.  

The user is solely responsible for all use of media files. The user is also obliged obligated to keep Aimpoint, the owner of the Media Portal, free/harmless from claims by image rights holders due to use that violates these Terms and Conditions.

RIGHTS, LIMITATIONS AND DATA STORAGE

The user acquires a non-exclusive and non-transferable right to use media files from Aimpoint Media Portal. Files may not be assigned, licensed, rented, or otherwise copied or distributed to third parties.

The right to use the file must be exercised within six months from the time of file download.

The user may not store the media file for any other purpose than the intended use at the time of download. If need for further use arises, the file must be downloaded from Aimpoint Media Portal again before it can be used. This is to ensure that the selected media file still is available and that the file is used in accordance with its current usage rights.

INDICATION OF NAME

If Attribution/Credit line is required in conjunction with the use of a media file, the name of the photographer or producer shall be indicated as close to the media files as possible.

NOTE: If the usage right description specifies a specific copyright this overrides the above way to write credits.

IMPROPER USE

The media files may not be used in any manner or context which might be perceived as offensive, misleading, or illegal (for example, pornographic or obscene). The files may not be used in such a manner that may offend or be defamatory to the photographer/producer and/or people depicted in the image.

The user is liable for any claims for damages which may rise because of claims brought by copyright holders or people depicted in the image due to improper use.

COPYRIGHT

All material in Aimpoint Media Portal is protected under the Copyright Act. This means that all copyrighted content, structure, design, selection, graphics, images, as well as all code, html, JavaScript, or the like is protected and not transferred to the user.

GDPR

Aimpoint Media Portal provides media files like photos and videos used for internal and external use and in some cases for commercial and editorial use.

Externally, only a limited content of our media portal appears. We want to provide a good user experience as well as offer photos and videos from our entire business.

To make it possible, we display images through our media portal with searchable metadata so that our users can easily search, compare, and utilize what suits their needs.

All processing of personal data is based on the provisions and requirements of the European Union’s General Data Protection Regulation (GDPR).

All images showing identifiable people are considered as personal data according to GDPR and require consent. All identifiable persons in the media files have given their consent.
