Terms of use - Media Portal
1. About
Please read these terms of use (“Terms”) carefully before using Aimpoint Media Portal (“Media Portal”). By using the portal, you accept and agree to be bound by our Terms. If you do not accept, you must not access or use the Media Portal.
2. Personal data
We process your personal data provided through our Media Portal in accordance with our Privacy Policy. For more information, please read our Privacy Policy.
Data subjects in the media files have entered into specific agreements with Aimpoint that allow the use of their personal data for marketing purposes.
3. Acceptable use
General
The Media Portal may only be used in accordance with these Terms and for lawful purposes. These Terms are binding on all Users of the Media Portal, include all media file types available for download in the Media Portal and applies to both printed and digital use.
“User” means the person, organization or company that downloads and uses an image or other media file type (film, publication, logotypes etc.) from the Media Portal. Aimpoint have the right to disable Users, Usernames and passwords if we suspect a breach of security or violation of these Terms.
The User acquires a non-exclusive and non-transferable right to use media files from the Media Portal. Files may not be assigned, licensed, rented, or otherwise copied or distributed to third parties.
Use of media files
Media files may be used free of charge in advertising, publications, and editorial coverage with the purpose of promoting Aimpoint products, brand, or company. Files may only be used by the User who downloaded them and accepted these Terms.
If Attribution/Credit line is required in conjunction with the use of a media file, the name of the photographer or producer shall be indicated as close to the media files as possible. Please note that if the usage right description specifies a specific copyright this overrides to write credits. Media files with special and/or limited right of use, shall only be used in accordance with attached “Usage Right Description” in addition to the Terms.
Media files are only allowed to be used/presented in the natural usage environments of Aimpoint products, meaning product field of use such as sport shooting, hunting, law enforcement and military. Any other use requires permission from Aimpoint.
Usage in informative publications with the purpose of increasing the knowledge about red dot sights in general is permitted. For example, it is permissible to use files in product test articles or videos to inform Users about the benefits of red dot sights. Merely using a file without clear reference to red dot sights or its natural usage environments is not deemed to promote the use of Aimpoint red dot sights or red dot sights in general and is, therefore, prohibited.
The User must always respect special/limited usage rights and act accordingly when using the media file. These media files are marked with an exclamation mark in the list view and have file specific usage rights (description presented in the lightbox view). In such cases, the alternative and/or additional usage rights shall be given priority over the general usage rights stated in these Terms.
Aimpoint trademarks, logos and taglines/slogans shall not be distorted, obscured, manipulated, or used in sizes that make it unrecognizable. Aimpoint Graphic and Trademark Guidelines must be read and followed (available on the Media Platform).
Limitations and data storage
The right to use the media file must be exercised within six months after the date the file was downloaded.
Image files may not be manipulated or distorted. Changes to, misrepresentation of, or misuse of any files is strictly prohibited except for proportional resizing. Video files must be used in their original uncut form.
The User may not store the media file for any other purpose than the intended use at the time of download. If the need for further use arises, the file must be downloaded from Aimpoint Media Portal again before it can be used.
The media files may not be used in any manner or context which might be perceived as offensive, misleading, or illegal (for example, pornographic or obscene). The media files may not be used in such a manner that may offend or be defamatory to the photographer/producer and/or people depicted in the image.
4. Terms of use
By accepting these Terms, the User also approves and accepts the applicable Terms of Use regarding the use of Aimpoint's trademarks etc. The Terms of Use are deemed to be incorporated in these Terms by reference: Terms of Use.
5. Indemnification
The User is solely responsible for all use of media files on the Media Portal. The User is obligated to indemnify Aimpoint, the owner of the Media Portal, from claims due to usage in violation of these Terms. The User is liable for any claims for damages which may arise because of claims brought by copyright holders or data subjects in media files if due to improper use.
6. Limitation on liability
Aimpoint makes no representations or warranties of any kind, expressed or implied, as to the operation of the Media Portal, the accuracy or the completeness of the information, content, materials or products included in the Media Portal. Aimpoint will not be liable for any damages of any kind arising from the use of the Media Portal, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
7. Changes to the terms
Aimpoint reserves the right to revise and update these Terms from time to time at its sole discretion and with immediate effect after publication on the website.
These Terms will be governed by and construed in accordance with the laws of Sweden, without giving effect to any principles of conflicts of laws.
